My landlord says the plumbing issue I have can only be repaired at “his discretion” . ?
Plumbing Problems November 20th, 2008When we first moved in (10 mo. ago) he knew there were plumbing issues because the house wasn’t winterized properly (pipes burst) and he sent a plumber out and the plumber told him (in my presence) what was wrong. The plumber was to come back the next day and repair the minor problem but he also told us some other areas that would eventually go wrong so we mentioned it to the landlord later the next day and when the plumber came back he said that the landlord chewed his butt about telling us what would eventually go wrong. So the plumber told us that whatever he tells us we can’t tell the landlord he said it. So now the landlord says that its at his discretion as to whether or not he will repair the plumbing issue especially since we’ve been late on our rent recently (we paid late fees & now we’re current). According to the lease it says any repairs over $200 the landlord pays it does not say at his discretion if that be the case we will never get any repairs made because I’m sure the discretion will never be in my favor. Should I pursue this matter?
It may be at his discretion. Will the issues in the plumbing make the unit uninhabitable? If so then he does have a legal obligation to get those issues fixed. Check with the local code/building inspector to see if he is responsible for those issues. If they say he needs to bring those issues to code then you have a leg to stand on. Also check with the state that you live in to see what your rights are as a tenant and what avenues of resolution you have.

go for it but youll never win. this is not your property and unless it is causing a hazard that is either environmental related or health related does not constitute immediate action.
how many people that own their own home actually fix stuff that is broken right away? not too many. same difference

Definately! Don’t let him push you around. I’m an electrician and I deal with a lot of these pricks that would charge you to live in there dog house if they could. They don’t want to pay anything and they’re always griping about the people that lives there. First you have obligations as a renter but they also have them as a landlord. Definately persue it.

surely the plumber might want to make some extra work for himself..
but its not up to him to decide what needs to be repaired or what ‘might’ go wrong.. that puts the landlord in a corner..
and yes.. it is at the lanlords discretion.. otherwise any plumber could put any price up and the lanlord pays?…. hello… surely the landlord has the right to make the spending decision…

Come on, people. You can’t make a landlord pay to have something fixed that might go wrong sometime later, but hasn’t yet.
After its happened, yes. You are all worrying about something that hasn’t happened, and may never happen. There are better and also more productive things to do.

If your plumbing is working you have nothing to worry about. Worry about it when you have a problem. Plus you cant make him pay for something that might happen untill it actually does happen.
